NOTICE INVITING TENDERS
Sealed tenders affixed with revenue stamps worth Rs:20/. for and on behalf of Governor J&K State, are invited by the Chairman State Level Purchase Committee Sheep Husbandry Department J&K, from original manufacturers or their authorized distributors for supply of Drugs, Serra vaccine, Lab equipments, Hospital instruments, Lab chemicals, Ayurvedic formulations for the year 2011-12 forming Section I (Annexure A&B) section II,III,IV & V. The tenders should reach the office of Director Sheep Husbandry Department KashmirLal- Mandi Srinagar/Rail Head Complex Jammu through Regd/Speed Post/Courier/by Hand or to be placed in the available tender box by or before 10-8-2011 upto 3.00 Pm. Tenders received after due date and time shall not be accepted. Postal or any other delay will not be entertained. In case the last date for receipt of tenders happens to be a holiday, the tenders shall be received on the next working day. The tenders shall be opened on the same day or on any other date convenient to the State Level Purchase Committee, which shall be notified by a notice to be pasted on the Departmental Notice Board and also circulated in local news paper. Tenderers or their authorized representatives can be present at the time of opening of the tenders. Complete set of tender documents alongwith terms and conditions will be available for sale with the Director Sheep Husbandry Department Srinagar/Jammu on all working days during working hours on cash payment of Rs:100/- for MICRO SMALL & MEDIUM ENTERPRISES and Rs:500/- for others (Non-refundable) against proper G.R or by demand draft of equivalent amount drawn in favour of Accounts Officer SHD, Kashmir payable at J&K Bank R.C.C Srinagar. The tender documents alongwith terms and conditions can also be down loaded from website www.JKanimalhusbanddry.net or http://jaktender.nic.in. The intended tenderers who wish to down load the tender documents on website will have to pay the prescribed documentations fee before submission of tenders. TERMS AND CONDITIONS:-
Tenders should be submitted in two separate covers contained in a single large envelop duly filled in. Cover I containing technical bid for pre-qualification of tender and Cover
II
containing quotation form financial (commercial bid) on the financial tender form and
should be complete in all respects addressed to the Chairman, State Level Purchase Committee
Sheep Husbandry Department J&K Kashmir.
Cover I containing Technical bid : For pre-qualification of tender the following
documents should be kept in this cover and be superscribed as technical bid
Earnest Money in the shape CDR for the required amount as indicated against each section. Original receipt of G.R/Demand Draft of Rs.500/-&Rs100/=(in respect of MICRO SMALL & MEDIUM ENTERPRISES). Certificates & Documents Vis-à-vis Valid Drug manufacturing License/Drug handling license along with list of products being manufactured, authenticated by competent authority.(Under process DML shall be entertained subject to the production of certificate from competent authority.) In case D M L expires during the course of rate contract, renewal drug license certificateissued by the competent authority needs to be produced. WHO with GMP along with ISO/ISI certification is mandatory for section I (Annexure A). Certificate to the effect that the drugs /medicines quoted are available in the open market across the counter with evidence /proof like sales /challans etc. and retailers receipts is Mandatory for Section I (Annexure A). Valid GMP/WHO/ISO-9001-2001 certificate VAT clearance certificate from Commercial Tax Department for the period ending 31.03.2011. Authorization letter nominating distributor with proper authority on non-judicial stamp paper attested by 1st class magistrate along with copy of valid license for sale of drugs of the concerned distributor. Active production certificate from competent authority as on date of submission of documents in case of MSME of J&K state. Copy of PAN NO. of the firm duly attested by the Notary Certificate from the Drug Controller of their respective states that the product for which rates offered has never been declared substandard during the last three years. Affidavit duly attested by the First Class Magistrate stating there in that the self attested/ stamped documents attached with tender are true/genuine. Only rates are to be quoted on the Tender form Annexed with the NIT. Rates are to be quoted strictly as per the unit of pack specified in the
NIT (Rates not quoted as per pack specified in the NIT shall not be
entertained )

Rates quoted should be uniform throughout the state inclusive of all
Taxes
/duties/levies/CST/VAT Cover II of only such tenderers shall be opened who qualify the conditions laid
down in technical bid (cover I)

Tender should be filled legibly in ink or typed out/computerized and submitted in the sealed envelope addressed to the Chairman State Level Purchase Committee Sheep Husbandry Department Lal-Mandi and superscribed as Tender for Section I (Annexure A/Annexure B) & Section II, III, IV & V with Complete address of the tenderer on the envelop. All the documents attached with the tender must be self attested and stamped indicating the name of signatory. 3 The tenderer should quote rates strictly as per the unit of pack etc. for the items as specified in the tender form/NIT, as per the specification laid down in "Drugs andCosmetics Act" and rules framed there under, for pharmaceutical items only. Any item quoted without having regard to this clause shall not be considered. 4. Only one rate against one item shall be quoted/entertained. The approved rates shall remain valid for a period of one year from the date of issuance of rate approval or till new rate contract is finalized, which-ever is earlier. 6. The Tenderer(s) should clearly record in their tender the make/brand with full Particulars/ specifications of the items complete in all respects. 7. The Drug manufacturing houses are required to submit their tender directly. However, they may nominate their distributor for execution of supply orders and receiving payments, if they so desire, with the proper authority on Non-Judicial stamp paper under the seal and signature of the tenderer itself. Nomination of the distributors after opening of tenders shall not be accepted and in that event the Drug Manufacturing House itself will be bound to execute supply orders. 8. The tenderer(s) should enclose with the tender, manufacturer's/company's price list, relevant to Hospital rates, where ever applicable and the supporting literature etc. as supplementing documents to the tender. It should be certified that the rates quoted conform to the "Drugs Price Control Order" issued by the competent authority as notified from time to time. It should also be certified that the rates quoted are in no way in excess of hospital rates quoted in other Government Departments & M.R.P. The tenderer (s) quoting rates in response to this NIT should attach a copy of Hospital price list duly authenticated by the concerned authority. In the event of any decrease in rates during contractual period the tenderer shall submit an undertaking duly attested by notary to reduce the rates correspondingly. No conditional or incomplete tender will be entertained. The purchasing officers of the department are not bound to purchase all or any items approved by the State Level Purchase Committee from the approved firms. 10. No withdrawal of rates shall be allowed after the last date of receipt of tenders or the extended date of receipt of tenders, as the case may be. The State Level Purchase Committee reserves the right to accept or reject any tender in full or in part without assigning any reason thereof. 12. The drugs should have minimum shelf life of one and half year on the date of receipt of supplies in the Stores and eleven month for such Vitamin preparations which have a total life span of one year. The date of manufacture should be latest, but not more than three months old on the date of receipt of supply. 13. The rates should be written legibly in ink or typed or computerized both in words and figures affixed with transparent cello tape. Cuttings, interpolations, over-writings and erasures in the rates quoted will not be entertained. The tenderer should sign the tender form at each page at the end in token of the acceptance of all terms and conditions of the tender and agreement. The word ‘No Quotation' should be written across all such items on the tender form for which tenderer does not wish to quote the rates. 14. The tenderers shall have to supply duly sealed samples for such items listed as sample items, in duplicate, strictly in accordance with the specification mentioned in the NIT against proper receipt along with the tender itself. The sample should also be of current manufacturing and should be marked serially and list provided of samples furnished correlating the marked serial with the items group/Serial indicating in the tender form. Any discrepancy would entail rejection of the item quoted. Approved samples will be kept under safe custody of the department, Rejected/unapproved samples shall have to be lifted by the tenderers within one month from the date of issuance of approved rate contract, at their own expenses, failing which the department will not bear any responsibility. Approved samples will be the property of the department and will be kept as reference samples for the contract period and for settling any dispute arising on account of supplies made, thereafter, these shall go to the Stores for use in the field, if still fit for use and discarded otherwise. 15. The tenderers quoting rates for insecticides/pesticides shall also be required to furnish Drug handling/manufacturing license making it clear in unambiguous terms the hazards/side effects of these Pesticides /insecticides etc. as per the provisions of Drugs and cosmetic act. 16. The rates of Drugs/Medicines/Instruments & Equipments which are imported from outside the country should be quoted only by such firms who are holding valid import license. Attested copies of such import license should be enclosed with their tenders. They shall also be responsible for clearance of their items from the Custom Department. However, any help required in this regard shall be extended by the Department. 17. The firm which quote rates are required to furnish a legible copy of valid DrugManufacturing License with a list of items allowed to be manufactured in the current year by the licensening authority duly attested by notary. The tenderer should clearly indicate in the tender form attached to the tender notice serial No. and Page No. of the list of approved product in DML. The approved supplier could be asked if felt necessary to produce documentary proof in respect of source of procurement of Technical Grade Material (TGM) and its cost and also the copy of import license, in case TGM has been imported. In that event if the supplier fails to provide the said documentation, the State Level Purchase Committee shall have the right to cancel the rate contract in respect of such items and the supplier shall not contest the case in any manner whatsoever. 19. The turnover of the company /firm should be Eight Crore per annum in respect of veterinary products to be certified by the chartered Accountant. However this condition shall not be applicable to MSME unit holders of J&K state having G M P and latest I S O certificate. However this clause shall not be applicable to section V ( Indigenous drugs). 20. The documents/certificates should be under the name & address of the premises where items quoted are actually being manufactured./.registered office. The price preference shall be given to local MSME of State as per the Govt. orders in vogue. A team of Departmental officers can visit and inspect the units of unit holders participating in tender process at any time during the course of completion of contract if deemed necessary. 22. The State Level Purchase Committee, Sheep Husbandry Department, J & K Srinagar reserves the right to accept the items even on higher rates for life saving drugs formulations and standard products keeping in view preferably the quality of medicine, clinical experience of expert members of committee, position/reputation of manufacturer in the market, Research & development effort of the manufacturer. G.M.P with revised scheduled mm3. The committee can consider the purchases on single tender basis provided the tenderer will furnish the certificate from the competent authority that he is the sole manufacturer/ proprietor for the item. 23. Any clarification required by the tenderers with regard to any point advertised in the NIT can be had from the Directorate of Sheep Husbandry Srinagar/Jammu before the last date of receipt of tenders and the tenderer should carefully examine/read the terms and conditions of the N.I.T, satisfy himself before quoting the rates in his tender. 24. It shall be obligatory for the approved suppliers that each and every strip/pack/vial is printed/marked with words indicating month and year of manufacturing, batch No./ date of expiry/approved departmental rate besides MRP and marked as "Supply of Department of Sheep Husbandry, J&K". 25. The samples collected at random from each batch of medicine/drugs supplied by verification committee will be subject to the testing through Drug Controller, J&K, or any other accredited testing house at the discretion of the verification committee of the department. In case, the test results of the particular batch of medicines/drugs is found to be of sub- standard quality, the supplier shall be bound to replace the particular batch of medicines/drugs by fresh batch or refund the whole payment received on account of such supplies. Any eventuality arising out of usage of such medicine/drug/sera vaccine in the field shall be at the risk & cost of supplier. The supplier is bound to repay the damages accrued to department/consumer on this account. The matter shall further be referred to the competent authority (drug controller) for initiation of legal proceedings as per the rules. The Tenderers should enclose the literature containing product details/specification for the item which have been quoted by them in the tender. The successful tenderer shall not assign/sub-let the contract in part or in full to any other agency. In such cases if it is found /learnt the contract shall be cancelled. 28. The tenderer shall be responsible for the proper packing so as to avoid damage under normal conditions of transport and delivery of the material in good condition to the consignee at destination. In the event of any loss/damage, or any shortage, the tenderer shall be liable to make good such losses andshortages found on checking /inspection of materials by the verification committee framed for the purpose . No extra cost on such account shall be admissible. 29. The contract for supply of medicines etc can be repudiated at any time if the supplies are not made to the satisfaction of the Department. 30. In case of any dispute between the supplier and the department, the case shall be referred to theAdministrative department Animal/Sheep for arbitration /settlement, whose decision shall be binding upon both the parties. 31. The State Level Purchase Committee reserves the right to ask for the samples of medicines and other items for purpose of verification of quality during the course of approval. 32. Any other condition not indicated here can be incorporated in the supply order or agreement before execution of contract if need arises.
E A R N E S T M O N E Y/SECURITY DEPOSIT/AGREEMENT

33. a) Every tender should be accompanied with a Call Deposit Receipt pledged to Accounts
Officer Sheep Husbandry Department Kashmir as per the amount noted here-under section wise:
1. Section I (Annexure A&B) Tenders without Call Deposit Receipt shall not be entertained. No Cheque, Cash or Bank Draft will be accepted in any case. No CDR/Security Deposits of previous year, if any, lying with the department will be considered for this tender. The Call Deposit Receipts of the un-successful tenderers shall be released to them in due course of time and the Call Deposit Receipts of the successful tenderers shall be retained till successful completion of the contract. Successful tenderers have to deposit an additional security equal to 5% of supply order in the shape of CDR. In case of non-deposit the equivalent amount on account of security shall be deducted from the running bills payable to firm and kept with held in the shape of CDR, which shall be released on receipt of supply in full and satisfactory test report of medicine samples.No interest will be paid by the Department on such security amounts. (b) The formal agreement deed incorporating the contract shall have to be executed by the successful tenderers/authorized signatory with the concerned Directorates on Non-Judicial Stamp paper of Rs. 20/-to the effect that he will abide by all the terms and conditions of NIT. The payment of the supplies made shall be released after the agreement is executed. The stamp fee and all other charges in preparation of two copies of the agreement shall be borne by the
approved supplier.
(c )The registered Micro Small & Medium Enterprises shall furnish existence and functional
status quo certificate for the current year issued by the respective General Managers of DIC. The
MSME of J&K State shall also furnish CDR as Earnest Money for the amount as per latest
Government Order. This will also be applicable to SICOP/Govt. undertakings of J&K State
being at par with MSME.
INSTRUCTIONS FOR MAKING SUPPLIES

34.(A) Once the rates of successful tenderers are approved, the purchasing officers of the
department shall place the orders for supply of Drugs/Instruments etc. required by them with the
approved supplier preferably in bulk or in parts within the budgetary provisions at their disposal
and the approved suppliers shall have to make the supplies within stipulated period mentioned in
the supply order. However, extension of supply period can be allowed by the respective
Directors in case they are satisfied with the reasons being beyond the control of the approved
supplier in any particular case.
The successful tenderer(s) shall be responsible for supply of Drugs/Medicines etc. in the original manufacturers packing. Rates quoted for Drugs/Medicines should be genuine and the items should conform to the pharmacopeial standards.Packing/Labelling should be as per thepharmacoepial requirements in unison with Drug & Cosmetics Act & rules amended from time to time. In case the goods other than the approved quality, make or size are supplied, they shall be rejected and will have to be replaced within a week s time without any extra cost.

MODE OF PAYMENT

35(a) No condition of advance payment shall be accepted. The payment of the goods shall
be made after supplies are received in the Departmental Stores, verified and accepted in
accordance with the specifications laid down in the NIT/Approved Rate List/Supply Order. In no
case, payment will be made for the ordered goods against RR/GR. The bills should indicate
complete details of the supplies made as per supply order.
(b) The payment shall be made to the supplier(s) after receipt of supplies in the Departmental
store duly verified by the Departmental verification committee through endorsed WDC bills at
Treasury in shape of Bank Drafts/Transfer credit to the firm and the bank charges shall be borne
by the firm.
36(a) The contract shall be binding upon the successful tenderers as soon as the acceptance of
the rates for the items approved in their favour are issued/communicated. In case any dispute is
raised by the approved supplier with regard to rates and other terms and conditions approved in
his favour which may or may not have been quoted by him, the same shall be considered only, if
raised within a period of 15-days from the date of issue of approved rate contract in his
favour. The copy of approved rate contract shall be dispatched to approved suppliers by
registered post by Member Secretary, State Level Purchase Committee, Sheep Husbandry
Department.
(b) Any loss sustained to the department as a result of re-tendering the contract or allotting
the same to second lowest tenderer due to backing out by the successful tenderer the extra cost
involved in such case, shall be recovered from the defaulting tenderer out of his earnest
money/security deposit or from any of his pending bills with the department or as arrears of Land
Revenue, as the case may be. Even, if the second lowest tenderer agrees to make the supply at
the rates of the first lowest, the CDR of the first lowest tenderer will be forfeited and shall have
no claim for the same and also shall have no right to raise this issue in any court of law. The
same procedure will be adopted in case of second lowest on his default and likewise for third
lowest.
(c) The approved suppliers should be registered with the Commercial Tax Department and
have to attach the copy of necessary certificates to the effect and also quote the Commercial tax
registration No./TIN No. in their tenders. They should also enclose a copy of their commercial
Tax/VAT clearance certificate with the tender itself.
37. All terms and conditions of the NIT shall form an integral part of the agreement, to be
executed by the approved supplier with the department.
PENALITY
38. In case the supplier(s) do not make full supplies in time, penalty up to 10% of the
unexecuted value of the orders shall be imposed at the discretion of the respective Directors of
Sheep Husbandry Department Jammu /Kashmir. In case any firm defaulting completely Earnest
Money shall be forfeited without any notice. The supplier shall have no right to claim its refund
even in the court of law. Refusal/non supply of ordered medicines/items within stipulated time
may result in risk purchase from other source at the cost of approved supplier and shall entail
forfeiture of earnest money/security deposit/debarment for future participation in tendering
process /black listing, besides any other action which the competent authority may deem fit to
be initiated against the defaulter.
39. Legal Proceedings, if any, between the parties and the Department shall be subject to the
jurisdiction of courts within Jammu & Srinagar Cities only.
