1.
EXAMPLE OF PAY AVERAGING
1.1 If the 38-hour week is to be implemented so as to give an employee a day off in each
work cycle this would be achieved if, during a work cycle of 28 consecutive days (that is, over four consecutive weeks) the employee's ordinary hours were arranged on the basis that for three of the four weeks the employee worked 40 ordinary hours each week and in the fourth week, the employee worked 32 ordinary hours. That is, the employee would work for eight ordinary hours on four days only in the fourth week - a total of nineteen days during the work cycle.
1.2 In such a case the averaging system applies and the weekly wage rates for ordinary
hours of work applicable to the employee shall be the average weekly wage rates set out in this award, and shall be paid each week even though more or less than 38 ordinary hours are worked that week.
1.3 In effect, under the averaging system, the employee accrues a "credit" each day the
employee works actual ordinary hours in excess of the daily average which would otherwise be 7 hours 36 minutes. This "credit" is carried forward so that in the week of the cycle that the employee works on only four days, the employee's actual pay would be for an average of 38 ordinary hours even though, that week, he/she works a total of 32 ordinary hours.
1.4 Consequently, for each day an employee works eight ordinary hours the employee
accrues a "credit" of 24 minutes (0.4 hours). The maximum "credit" the employee may accrue under this system of 0.4 hours on nineteen days; that is, a total of 7 hours 36 minutes.
1.5 Absences from duty
1.5.1
An employee will not accrue a "credit" for each day the employee is absent from duty other than on annual leave, long service leave, public holidays, paid sick leave, workers compensation, bereavement leave or jury service. The employee's entitlement is determined in accordance with the appropriate award provisions dealing with such entitlements.
An employee who is absent from duty (other than on annual leave, long service leave, public holidays, paid sick leave, workers compensation, bereavement leave or jury service) shall, for each day the employee is so absent, lose average pay for that day calculated by dividing the employee's average weekly wage rate by five.
An employee who is so absent from duty for part of a day shall lose average pay for each hour the employee is absent by dividing his or her average daily pay rate by eight.

As the employee is absent from duty the employee will not accrue a credit" because he or she would not have worked ordinary hours that day in excess of 7 hours 36 minutes for which he would otherwise have been paid. Consequently, during the week of the work cycle the employee is to work less than 38 ordinary hours the employee will not be entitled to average pay for that week. In that week the average pay will be reduced by the amount of the "credit" the employee does not accrue for each whole day during the work cycle the employee is absent. The amount by which an employee's average weekly pay will be reduced when the employee is absent from duty (other than on annual leave, long service leave, public holidays, paid sick leave, workers compensation, bereavement leave or jury service) is to be calculated as follows:

1.5.5 Examples
An employee's ordinary hours are arranged so that he or she works eight ordinary hours on five days of each week for three weeks and eight ordinary hours on four days of the fourth week.

APPENDIX B - PORTABILITY OF LONG SERVICE LEAVE
This appendix applies to employees employed by employers or employer members of an
employer association, listed in Schedule A of this Appendix, where such employers are
engaged in the contract cleaning industry.
1. DEFINITIONS
1.1 Contract Cleaning Industry means the industry which involves the work of persons
subject to this award employed by a cleaning contractor at office cleaning or general cleaning of a like character in or about any building (including a private dwelling).
1.2 Continuous
means for the purpose of this Appendix continuous service in the
contract cleaning industry since 1 January 1981, which service is deemed to be continuous notwithstanding:
the taking of any annual leave or long service leave; or
continuous leave of absence in accordance with the award of not more than 48 weeks on account of illness or injury; or
any interruption or ending of employment by any employer if the interruption or ending was made with the intention of avoiding obligations in respect of long service leave or annual leave; or
any absence from work of a worker for the purpose of:
1.2.4(a)
complying with a summons to appear as a juror; or
1.2.4(b) complying with a subpoena to give evidence before any court, body or
person before whom or which a person may by law be required to appear to give evidence; or
1.2.4(c)
taking personal leave as prescribed by this award; or
1.2.4(d)
any interruption arising directly or indirectly from an individual dispute; or
1.2.4(e)
the standing down of a worker due to a slackness of trade; or
1.2.4(f)
any continuous absence from work not in excess of two years on account of illness or injury which happened during a period when the worker's employment was in the industry if the absence is certified to be necessary by a legally qualified medical practitioner; or
1.2.4(g)
any other absence of the employee with the prior approval or subsequent acquiescence of the employer not exceeding twelve months; or
1.2.4(h)
any absence from work of an employee for parental leave; or

1.2.4(i)
the termination by the employer of an employee provided he or she is re-employed in the contract cleaning industry within a period not exceeding three months after his or her termination.
1.2.4(j)
any period of employment of an employee by another corporation which by virtue of Clause 7 (5) of the Companies (Victoria) Code is deemed to be related to the corporation first employing the employee.
Provided that any employee who voluntarily terminates a contract of employment breaks his or her service.
Qualifying service, for the purposes of this appendix, means service in the
contract cleaning industry for which an entitlement to long service leave accrues.
Qualifying service shall include:
1.2.5(a)
continuous employment or continuous service, within the meaning of that term as it was used in the
Long Service Leave Act 1992 (Victoria), with an employer in the contract cleaning industry prior to 1 January 1981; and
1.2.5(b) all time actually worked in the contract cleaning industry after 1 January
1981, for an employer or employers bound by this appendix; and
1.2.5(c) any interruption resulting from an event specified in 1.2.5(a), 1.2.5(b),
1.2.5(c) and 1.2.5(c)(i) inclusive of the definition of continuous service - but shall not include:
1.2.5(c)(i)
any period of service which has given rise to any entitlement to long service leave pursuant to Part VII of the
Industrial Relations Act 1979 (Victoria), or the
Employee Relations Act 1992, or the
Long Service Leave Act 1992 (Victoria),
where that entitlement to paid leave has been taken; or
any period of service for which a payment has been made pursuant to 3.2 of this Appendix.
2. ENTITLEMENT
A cleaner in respect of continuous service in the contract cleaning industry is entitled to long
service leave as prescribed in this Appendix. The period of leave is determined by reference
to an employee's qualifying service (as defined).
3.
PERIOD OF LEAVE
The long service leave to which a cleaner with continuous service in the contract cleaning industry is entitled shall be that prescribed in this Appendix.

3.1 In the case of a Cleaner who has completed at least fifteen years qualifying service -
thirteen weeks long service leave and thereafter an additional four and a third weeks long service leave on the completion of each additional five years qualifying service in the contract cleaning industry.
3.2 In the case of a Cleaner who has completed at least ten but less than fifteen years
qualifying service and who ceases to be employed in the contract cleaning industry for any cause other than termination by the employer for serious and wilful misconduct - such amount of long service leave as equals 1/60th of the period of his qualifying service.
3.3 In the case of a Cleaner who has completed more than fifteen years qualifying service
and whose employment in the industry is terminated otherwise than by the death of the worker - an amount of long service leave equal to 1/60th of the period of his/her qualifying service since the last accrual of entitlement to long service leave under 3.1.
TAKING OF LEAVE
When an employee becomes entitled to long service leave under this Appendix that leave
shall be granted by his/her employer as soon as practicable having regard to the needs of the
establishment but subject to this Appendix.
4.1 The taking of the leave may be postponed to such day as is mutually agreed or in default
of agreement as the Commission having regard to the problems involved directs but no such direction shall require the long service leave to commence before the expiry of six months after the giving of the direction.
4.2 In no case shall an entitlement to long service leave be lost or in any way affected by the
foregoing provisions of this clause or by the failure or refusal of the employer to grant the leave.
4.3 Notwithstanding anything to the contrary above, where the employment of an employee
in the contract cleaning industry ceases before he or she takes all the long service leave to which he or she is entitled or where a long service leave entitlement accrues to an employee because of the termination of his or her employment and the employee, whether or not he or she may continue to be continuously employed in the contract cleaning industry, wishes to take accrued long service leave, the employee shall be deemed to have commenced to take his or her leave on the day his or her employment was terminated and he or she shall be entitled to be paid on the day of termination by his or her employer the full amount of long service leave entitlement as at that day.
4.4 If an employer and an employee so agree:
4.4.1
the first thirteen weeks long service leave to which the employee becomes entitled may be taken in two or three separate periods; and
any subsequent period of long service leave to which the employee becomes entitled may be taken in two separate periods.
This subclause shall not affect the right of an employee to take leave in one period.

PAYMENT FOR PERIOD OF LEAVE
5.1 An employee on long service leave is entitled to be paid for the employee's normal
weekly number of hours worked calculated at the appropriate ordinary time rate of pay applicable, subject to this clause, as at the time of the employee taking leave.
5.2 The pay of an employee on long service leave shall be paid to him or her by the
employer when the leave is taken and shall be paid in one of the following ways:
In full when the worker commences his/her leave; or
At the same time as it would have been paid if the employee were still on duty; in which case payment shall, if the employee so requires, be made by cheque posted to a specified address; or
In any other way agreed between the employer and the employee and the right to receive ordinary pay in respect of the leave shall accrue accordingly.
5.3 Where an employee who is on long service leave has been paid either partially or in full
for the period of leave and his or her ordinary pay increases during the period of the leave, he or she shall be entitled to be paid at the increased rate as from the time of the increase, and the employer shall forthwith pay him or her the difference on his/her return to work.
5.4 Any long service leave shall be inclusive of any public holiday occurring during the
period when the leave is taken, but shall not be inclusive of any annual leave occurring during that period.
6. PAYMENT IN LIEU OF LONG SERVICE LEAVE ON DEATH OF
EMPLOYEE
6.1 If an employee entitled to long service leave dies before or while taking that leave, his
or her employer shall thereupon pay to his or her personal representative an amount equal to the ordinary pay that would have been payable to the employee in respect of the period of long service leave not taken by the employee less any amount already paid to the employee in respect of any of that leave not taken.
6.2 Where an employee who has completed at least ten years qualifying service in the
contract cleaning industry dies while still employed in the industry, his or her employer shall thereupon pay to his or her personal representative an amount equal to his or her ordinary pay for a period equalling one-sixtieth of the period of continuous employment.
LEAVE TAKEN IN ADVANCE
7.1 An employer may by agreement with an employee grant long service leave to the
employee before the entitlement to that leave has accrued. (Hereafter called leave in advance.)

7.2 Where leave in advance is granted and taken, the employee shall not be entitled to
further leave or to payment in lieu thereof for the period of qualifying service in respect of which the leave was taken before its entitlement accrued.
7.3 Where the employment within the contract cleaning industry of an employee who has
taken leave in advance ceases, the employer may from any remuneration payable to that employee upon termination deduct and withhold an amount equal to that part of the amount paid by him or her to the employee in respect of leave in advance to which the employee had not become entitled before he or she left employment in the industry.
CONTRACTING OUT PROHIBITED
Save as otherwise expressly provided in this Appendix, the provisions of this Appendix shall
have effect notwithstanding any stipulation to the contrary whether made before or after the
date of operation of this award and no contract or agreement made or entered into either
before or after the commencement of this award shall operate to annul or vary or exclude any
of the provisions of this Appendix.
9. APPORTIONMENT OF EMPLOYEE ENTITLEMENT BETWEEN
EMPLOYERS
An employer shall be liable to pay that proportion of an employee's entitlement to long service leave which bears to the cost of an employee's long service leave entitlement the same ratio as the number of ordinary hours worked by the employee during the period or periods of service of the employee with an employer bears to the total number of ordinary hours worked during the worker's qualifying service.

1. OPERATION
This appendix shall regulate the operation of traineeship in the cleaning industry.

3. PARTIES
This appendix shall be binding on:
3.1 the Australian Liquor, Hospitality and Miscellaneous Workers Union;
3.2 all employers party to this award;
3.3 all employees engaged as trainees whether members of the Australian Liquor,
Hospitality and Miscellaneous Workers Union or not who are employed by the employers in relation to the conduct of a traineeship (as defined).
4. APPLICATION
4.1 Subject to 4.2 and 4.3, this award shall apply to trainees and employers who have
entered into a current training contract approved and accredited by the relevant State Training Authority.
4.2 At the conclusion of the traineeship, this Appendix ceases to apply to the employment
of the trainee and the relevant award shall apply to the former trainee.
RELATIONSHIP TO PARENT AWARD
This Appendix should be read and applied in conjunction with the relevant parent award as
defined in clause 7 - Definitions of this Appendix, provided that where the terms of this
Appendix conflict with the terms of the parent award, the terms of this Appendix shall prevail.

6. DEFINITIONS
6.1 Approved
training means training undertaken (both on or off the job) in a traineeship
and shall involve formal instruction, both theoretical and practical, and supervised practice in accordance with a traineeship scheme approved by the relevant State Training Authority or NETTFORCE. The training will be accredited and lead to qualification at the Australian Qualifications Framework 2 or above.
6.2 Australian vocational traineeship system (or
AVTS) means a system of structured
training comprising on the job and off the job training, provided by an accredited training provider as approved by the relevant State Training Authority under appropriate State legislation or any equivalent system of structured training which provides from a training program developed by the Property Services Industry Training Advisory Board, which provides for a minimum of twenty hours training and training related employment each week of the traineeship.
6.3 Australian standards framework (or
ASF) means the national framework of
competencies of skills as defined by the Standards and Curriculum Council.
6.4 Australian qualifications framework (or
AQF) means the national framework of
qualifications as agreed by the Ministerial Council for Employment Education Training and Youth Affairs (MCEETYA).
6.5 Relevant
award means the
Building Services (Victoria) Award 2003.
6.6 Relevant
union means the Australian Liquor, Hospitality and Miscellaneous Workers
means an employee who is bound by a traineeship agreement made in
accordance with this Appendix.
6.8 Traineeship means a system of training which has been developed by the Property
Services Industry Training Advisory Board, and approved by the relevant State Training Authority, or which has been approved on an interim basis by NETTFORCE. A traineeship shall provide for a minimum of twenty hours training and training related employment each week.
6.9 Traineeship
agreement shall mean an agreement made subject to the terms of this
award between an employer and the trainee for a traineeship and which is registered with the relevant State Training Authority or under the provisions of the appropriate State legislation.
6.10 Appropriate State legislation means the
Vocational Education and Training Act 1990
(Victoria) or any successor legislation.
7. TRAINING
CONDITIONS
7.1 The trainee shall attend an approved training course or training program prescribed in
the traineeship agreement or as notified to the trainee by the relevant State Training Authority.

7.2 A traineeship shall not commence until the relevant traineeship agreement, has been
signed by the employer and the trainee and lodged for registration with the relevant State Training Authority, provided that if the traineeship agreement is not in a standard format a traineeship shall not commence until the traineeship agreement has been registered with the relevant Sate Training Authority.
The employer shall ensure that the trainee is permitted to attend the training course or program provided for in the traineeship agreement and shall ensure that the trainee receives the appropriate on-the-job training.
7.3 The employer shall provide a level of supervision in accordance with the traineeship
agreement during the traineeship period.
7.4 The employer agrees that the overall training program will be monitored by officers of
the relevant State Training Authority and that training records or work books may be utilised as part of this monitoring process.
7.5 Training shall be directed at:
7.5.1
the achievement of key competencies required for successful participation in the workplace (where these have not been achieved) (eg. Literacy, numeracy, problem solving, team work, using technology), and as are proposed to be included at the ASF 1 level. This could be achieved through foundation competencies which are part of endorsed competencies for an industry or enterprise; and/or
the achievement of competencies required for successful participation in an industry or enterprise (where there are endorsed national standards these will define these competencies), as are proposed to be included in the AQF Certificate 2 or above.
8. EMPLOYMENT
CONDITIONS
8.1 A trainee will generally be engaged on a part-time basis for a maximum of one year's
duration, provided that in some circumstances trainees may be engaged as full-time employees. A trainee, whether full-or part-time, shall be subject to a satisfactory probation period of up to one month which may be reduced at the discretion of the employer.
8.2 Part-time trainees may transfer from a part-time to a full-time traineeship position
should one become available. A trainee who is offered and accepts a full-time position cannot be transferred back to a part-time position. The union shall be notified of any instances where a trainee takes up a full-time traineeship position.
8.3 An employer shall not terminate the employment of a trainee without firstly having
provided written notice of termination to the trainee concerned in accordance with the traineeship agreement and subsequently to the relevant State Training Authority.
8.4 An employer who chooses not to continue the employment of a trainee upon the
completion of the traineeship shall notify, in writing, the union and the relevant State Training Authority of their decision, giving reasons why such employment is not available.

In circumstances where such reasons are not deemed to be satisfactory, the employer shall not be eligible to engage additional trainees for a period of twelve months.
8.5 The trainee shall be permitted to be absent from work without loss of continuity of
employment and/or wages to attend the training in accordance with the traineeship agreement.
8.6 Where the employment of a trainee by an employer is continued after the completion of
the traineeship period, such traineeship period shall be counted as service for the purposes of any relevant award or any other legislative entitlements.
8.7 All other terms and conditions of the relevant award that are applicable to the trainee or
would be applicable to the trainee but for this Appendix shall apply unless specifically varied by this Appendix.
8.8 A trainee who fails to either complete the traineeship or who cannot for any reason be
placed in work based on
ordinary hours of work as prescribed under the award with the employer on successful completion of the traineeship shall not be entitled to any severance payments payable pursuant to termination, change and redundancy provisions or provisions similar thereto.
8.9 A trainee who successfully completes the prescribed training program and is assessed as
competent to perform to the required industry standard within one year shall be considered as available for work based on the ordinary hours of work as prescribed in the award.
9. WAGES
9.1 The wage payments hereunder shall only apply to trainees while they are undertaking an
approved traineeship which includes approved training as defined in this Appendix.
9.2 The wages payable to trainees shall be 80% of the relevant adult hourly rate of pay
provided for in this award for all time worked including such time as is spent on approved training.
The minimum weekly training wage shall be: 80% of the relevant adult hourly award rate x 20. Provided that the relevant hourly award rate shall include any penalties and loadings contained in the relevant award.
9.3 Time spent on approved training shall be 20% of the total time of the period of
engagement of the employee under the traineeship agreement.
9.4 The trainee shall be entitled to overtime and shift penalty rates and allowances
prescribed by the relevant award. The trainee wage shall be the basis for the calculation of overtime and/or shift penalty rates.
9.5 In cases where a trainee accepts a full-time position, the following will apply:

the proportion of training time shall increase proportionate to the increase in overall weekly hours. That is, the trainee shall increase the time spent on approved training to 20% of 38 hours per week, or one day per week.
10. PREVENTION AND SETTLEMENT OF INDUSTRIAL DISPUTES
10.1 The parties to this Appendix shall meet regularly with relevant training authorities to
monitor the implementation of the traineeship within the industry.
10.2. Any dispute shall be dealt with under the grievance and dispute settling procedure
contained in the relevant award.
11. REVIEW
APPENDIX
The parties shall review the operation of this Appendix, including traineeship outcomes no
later than twelve months from its initial operation.
12. SUPERSESSION
Any existing award provisions for the Australian Vocational Traineeship System shall not
apply to any employer bound by this award, except in relation to AVTS trainees who
commenced a traineeship with the employer before the employer was bound by this award.

PARTIES BOUND
The award known as the Building Services (Victoria) (Interim Roping-in No. 5) Award 2002
shall be binding according to its terms upon the Australian Liquor. Hospitality and
Miscellaneous Workers Union ("the Union"), its officers and members and A. Cleaner World
Cleaning Services, 26 Young Street, Moonee Ponds 3038, in respect of their employees
whether members of the Union or nor.
4.
DATE TIME AWARD STARTS
This Award shall operate from the first pay period on or after 10 September, 2002 and shall
remain in force for a period of six months.
5-APPLICATION
5.1 Subject to that which is provided for it, clause 5 of this Award, the provisions of The
Building Services (Victoria) Award 1994, as varied from time to time shall apply.
The following clauses of Building Services (Victoria) Award 1994 shall not apply:

PART 2- SPECIFIC CONDITIONS
6.
UNIFORMS & PROTECTIVE CLOTHING
6.1 All employees with not less than 4 weeks service who are required by the employer to
wear a. uniform or overalls shall be paid the uniform allowance as provided for by clause 17(b) of the Building Services (Victoria) Award 1994 as varied from time to time.
6.2 The employer shall not be obliged to pay the uniform allowance referred to in clause 6.1
in the event such uniforms or overalls are supplied by the employer at no expense to the employee.
AVOIDANCE OF INDUSTRIAL DISPUTES
7.1 The employer will contact the Supervisor and attempt to settle the matter at that level.
The employee may appoint another person to act on their behalf, including a union delegate.
Where the shop steward or delegate is involved he/she shall be allowed the necessary time during working hours to interview the employee(s) and the supervisor.
7.2 If agreement is not reached at this level the employee and their nominated
representative, if any, will meet with the Supervisor, the Manager and the Personnel Manager if necessary.
7.3 If the matter is not resolved at these discussions the employee may notify a more senior
union official/employee representative of the nature of the grievance for discussions to be carried out between representatives of the management and the union/employee representative.

The shop steward or delegate shall be allowed at a place designated by the employer, a reasonable period of time during working hours to interview the duly accredited Union Officials of the Union to which they belong.
7.4 It is agreed that there is a commitment by me parties to achieve adherence to this
procedure. This should be facilitated by the earliest possible advice by one party to the other of any issue or problems which may give rise to a grievance or dispute.
7.5 It is agreed that the work shall continue during the period of negotiation, discussion and
consultation, except in the case of work which is considered to be unsafe. In any case where work is considered to be unsafe. the safety officer and safety representative shall be immediately consulted to determine whether safety regulations are being observed.
